# Can my boss make me share my tips with the kitchen in BC?

**Short answer:** **Yes. Under sections 30.3 and 30.4 of B.C.’s Employment Standards Act, your employer can pool tips and redistribute them among some or all employees, and it decides which employees get a share and how much.** What it can’t do is keep any for itself unless the owner does similar work to the staff, or take anything out of the pool or out of card tips, including processing fees or a dine-and-dash fund.

## The rules in British Columbia

| Rule | What it says |
| --- | --- |
| Tip pools | An employer may collect tips and redistribute them among some or all of its employees (s. 30.4(1)). Outside a pool or a legal requirement such as a garnishment order, it can’t withhold your tips or make you give them up. |
| Who gets a share | The employer decides which employees get a share from the pool and how much each one gets. |
| Owners, directors and shareholders | Can’t share in redistributed tips unless they do similar work to the employees who received them (s. 30.4(3) to (5)). |
| Card fees and other deductions | No deductions from a tip pool or from tips the employer has access to, such as debit or credit card tips. It can’t charge you for costs like a dine-and-dash fund. |
| What counts as a gratuity | Tips customers pay to the person who served them, and mandatory gratuities or service charges large groups are required to pay. |
| Getting tips back | Tips aren’t wages, but the Employment Standards Branch can recover withheld tips for you the same way it recovers wages. |

> “Employers cannot deduct from a tip pool, or from tips to which the employer has access, such as those made through debit or credit cards.” (B.C. Employment Standards: Interpretation guidelines, gratuities (section 30.3), https://www2.gov.bc.ca/gov/content/employment-business/employment-standards-advice/employment-standards/forms-resources/igm/esa-part-3-section-30-3)

## What’s different in British Columbia

B.C. is stricter than its neighbours on money leaving the pool. Card tips arrive whole: the interpretation guidelines bar any deduction from pooled tips or from debit and credit tips the house handles, so there’s no processing-fee carve-out. A shared fund for walkouts is out too.

Where it’s loose is the guest list. The Act lets the government name classes of employees who can’t be in a pool, and the province’s guide puts no limit on which staff the employer chooses, so cooks, dishwashers and hosts can all be written in. The one test for the owner, a director or a shareholder is doing similar work to the tipped staff. Large-party service charges count as gratuities here, so they fall under the same protection.

**Still open:** The guide doesn’t say whether the pool rules must be in writing or posted, and sets no maximum share. Section 30.4(2) allows classes of employees to be barred from pools by regulation; the pages we read name none.
