# What benefits can servers get in Nova Scotia?

**Short answer:** **If your restaurant has no drug plan, register for Family Pharmacare: it has no premium and costs nothing unless you fill prescriptions.** Your share is capped each year by family size and income. The Labour Standards Code gives 4% vacation pay, six paid holidays if you qualify, and 5 unpaid sick days a year. File your taxes to get the Affordable Living Tax Credit, paid quarterly.

## The rules in Nova Scotia

| Rule | What it says |
| --- | --- |
| Health coverage (MSI Health Card) | Moving from another province, coverage usually starts the first day of the third month after you become a resident. You must make your primary home here and be present 183 days a year. Fill in the registration form, then submit it through the link MSI emails you; there’s no fee. |
| Family Pharmacare | For residents with a valid Health Card who have no drug coverage or face costs that are a burden. No premium. You pay toward an annual deductible and a 20% co-payment, both capped by family size and income; after that the program pays until March 31. Renew by April 1 each year. |
| Affordable Living Tax Credit | Quarterly payments with the federal GST/HST credit, based on the previous year’s return. A base of $255 for an individual or couple plus $60 per child, reduced by 5 cents per dollar of adjusted family income over $30,000. |
| Vacation and vacation pay | Two weeks after each 12 months of work, three weeks from the ninth year. Vacation pay is at least 4% of gross wages, 6% from the start of the eighth year, for full-time, part-time, casual and seasonal staff. |
| Paid holidays | Six: New Year’s Day, Heritage Day, Good Friday, Canada Day, Labour Day and Christmas Day. You qualify if you were entitled to pay on 15 of the 30 days before and worked your scheduled shifts before and after. Work one and you get a regular day’s pay plus 1½ times your rate. |
| Sick leave | Up to 5 unpaid days a year for your own illness or injury, plus 3 unpaid days for family care or appointments. A note can only be required after more than 5 consecutive days or two earlier absences in 12 months. |
| Serious illness leave | Up to 27 weeks unpaid for a diagnosed serious illness or injury, after 3 months with the employer. |

## What’s different in Nova Scotia

Nova Scotia’s Labour Standards Code lists only six paid holidays, with Remembrance Day handled by a separate law. The qualifying test is about being entitled to pay on 15 of the previous 30 days, not about working them, and a day you weren’t scheduled doesn’t count against you. Restaurants that normally open on Sundays and holidays may count as a continuous operation, which lets the employer pay straight time for a holiday worked and give you another paid day off instead.

Vacation pay steps up to 6% at the start of your eighth year, and vacation time to three weeks in your ninth. Family Pharmacare is worth joining as a safety net, since it costs nothing until you need it. Beyond these, the federal benefits apply as well, like the Canada Workers Benefit.

**Still open:** The Affordable Living Tax Credit amounts come from a provincial factsheet last revised in April 2025; the CRA sets each year’s payment. The Labour Standards pages don’t say whether tips count toward vacation or holiday pay, and amendments tabled on 2026-09-08 aren’t law yet.
