# Can my boss make me put my tips in a pool in Saskatchewan?

**Short answer:** **Yes, your employer can require you to put tips into a pooling arrangement that redistributes them to other employees.** It must tell staff about the pool, for example by posting it at work, and keep records of it for two years after it ends. It can’t make you pay wages into the pool or keep tips to cover theft, errors or damage. Owners share only if they regularly do the same work.

## The rules in Saskatchewan

| Rule | What it says |
| --- | --- |
| Required pools | An employer may require employees to provide their tips to a pooling arrangement for redistribution to other employees. |
| Telling staff | The pool must be made known: posted in a clearly visible place at work, online on a secure site employees can reach, or another way that makes sure employees know. |
| Records | The employer keeps records of the pool for two years after the arrangement ends. A pool would typically set out the participants, contributions, distribution rules and record-keeping. |
| Owners, directors and shareholders | A proprietor, partner, director or shareholder may share only if they regularly perform the same work as the employees in the pool. |
| Wages and business costs | Employers can’t require you to contribute wages to a tip pool, and can’t keep tips to cover business costs such as theft, errors, damage or wages. |
| Deductions from card tips | On tips collected through payment systems, only statutory deductions (income tax, EI, CPP) sent to the proper authority, and no more than required. |
| Tips and pay calculations | Tips aren’t wages under The Saskatchewan Employment Act, so they’re left out of your hourly wage, pay instead of notice, public holiday pay, vacation pay and overtime rate. |
| Getting tips back | Employment Standards can recover unlawfully withheld tips like wages, through a wage assessment. |

## What’s different in Saskatchewan

Saskatchewan puts paperwork duties on the pool itself. Your employer has to make sure you know the arrangement exists, whether that’s a notice on the wall or a staff website, and must hold on to the pool’s records for two years after it ends. That gives you something concrete to ask for if a split looks off.

It also closes a door some pools leave open: only tips go in, never your hourly pay. The flip side is that tips count for nothing in your holiday pay, vacation pay or overtime rate, because the province doesn’t treat them as wages. The guide names no list of who may receive from the pool beyond “other employees.”

**Still open:** The province’s page doesn’t say which employees may or may not receive from a pool, or set a maximum contribution. It calls the listed contents of a pool (participants, contributions, distribution rules) what a pool “would typically” detail, not a requirement.
