# Can I quit my serving job over text, or do I have to do it in person?

**Short answer:** **Yes, you can quit by text. Federal wage law has no rule that you quit in person or give notice.** Telling your manager in person or by phone is kinder and keeps a reference open, so do that when you can, then follow up in writing. Either way, put your last day in the text. If your regular payday passes and your final pay hasn’t come, contact DOL or your state labor office.

## Copy-paste texts

Names and dates are made up.

| Situation | Text |
| --- | --- |
| After telling them in person | “Hi, it’s Sam. Following up on our talk today: my last shift will be Saturday, June 20. Thanks for everything.” |
| With notice, by text | “Hi, it’s Sam. I’m giving my two weeks. My last shift will be Saturday, June 20. I’d like to tell you in person too. When are you in?” |
| Leaving right away | “Hi, it’s Sam. I’m sorry for the short notice, but I won’t be able to work any more shifts. Tonight will be my last. Please let me know how I’ll get my final paycheck.” |
| When you don’t feel safe going back | “Hi, it’s Sam. I’m resigning, effective today. Please send my final pay the usual way and let me know how to return my apron and key.” |
| Final pay follow-up | “Hi, it’s Sam. My last shift was June 20. Payday for that period was July 3 and I haven’t received my final check. Can you check on it?” |

**Not tax or legal advice.** These are wording suggestions. State final-paycheck rules can be stricter than the federal one.

## Plain English

### Text or in person?

Legally, either. In practice, telling a manager to their face, or at least by phone, goes over better, and you may want a reference later. A good middle ground: tell them in person or by phone, then send a short text with your last day so there’s a written record. If a workplace feels unsafe, you don’t owe anyone a face-to-face conversation. A text is fine.

### What federal law says about notice

DOL’s guide to the Fair Labor Standards Act lists no rule that a worker give notice before quitting. There’s more on this in [Do I have to give two weeks’ notice?](https://www.tipmaxapp.com/us/answers/do-servers-have-to-give-two-weeks-notice) Your employer’s handbook may ask for notice, and a restaurant may not rehire someone who left without it.

### Your final paycheck

DOL says federal law doesn’t require your employer to give you your final paycheck right away, and that some states may require immediate payment. If the regular payday for your last pay period has passed and you haven’t been paid, DOL says to contact its Wage and Hour Division or your state labor department.

### Before you send it

- **Write down your last shifts:** dates, hours, and tips. That’s what you’ll check the last stub against.
- **Report your tips.** IRS Publication 531 says that if your job ends during the month, you can report your tips to your employer when it ends.
- **Save your pay stubs** and any schedule screenshots before you lose access to the work app.
- **Return what’s theirs** (keys, apron, a card) so nothing holds things up.

### Where to ask

DOL’s Wage and Hour Division takes calls at 1-866-487-9243. Your state may have stricter final-pay rules; DOL keeps a [list of state labor offices](https://www.dol.gov/agencies/whd/state/contacts).

## Common mistakes

- Just not showing up without any message.
- Leaving the last day out of the text.
- Losing access to your pay stubs before you’ve saved them.
- Assuming the final check is late the day after you leave. Under federal law, the question is whether your regular payday has passed.

**Still open:** State final-paycheck and notice rules differ and aren’t covered here. We found no DOL page that speaks directly to notice from a worker who quits.
