# Can my manager or the owner take money from the tip pool?

**Short answer:** **No.** Federal wage law bars managers, supervisors, and owners who actively manage with at least a 20% stake from taking any part of your tips, including from a pool. That holds whether or not you’re paid a tipped cash wage. A manager can keep tips from customers they alone served. The trap is the working manager: covering a bar shift doesn’t earn a pool share. For taxes, pool money a manager gets isn’t a qualified tip.

## Example math

Saturday night. The pool for servers, bartenders, and bussers is **$1,500**. Your general manager covers the bar for four hours, and customers at the bar tip him **$120** directly for drinks he alone made and served.

1. The manager can keep the **$120** he got directly for his own service. Your employer can also require him to contribute a portion of it to the pool.
2. The manager can’t take a share of the **$1,500** pool, even for the hours he bartended.
3. Say the house split had given him a $150 share (illustrative). That $150 belongs to the servers, bartenders, and bussers.

**For taxes:**

- Any pool money a manager receives isn’t a qualified tip for the federal tip deduction.
- The $120 he got directly while bartending can count, if the other rules are met. Bartenders are on the IRS list (code **101**).

**Not tax or legal advice.**

## Plain English

### Federal wage law: managers stay out of the pool

Federal wage law says your employer can’t keep any part of your tips, and can’t let managers or supervisors keep any either. That covers taking from a tip pool or a tip jar, because those hold other employees’ tips. It applies whether your employer pays you a tipped cash wage or the full minimum wage.

### Who counts as a manager

For tip purposes, a title doesn’t decide it. DOL uses a duties test. Someone counts as a manager or supervisor if all of these are true:

- Their main job is managing the business or a department.
- They regularly direct the work of at least two full-time employees, or the equivalent.
- They can hire or fire, or their input on hiring, firing, and promotions carries real weight.

Pay doesn’t matter here. A manager for tip purposes doesn’t have to be on salary or earn a set amount. An owner with at least a 20% stake who actively manages also counts.

### When a manager works the floor

A manager can keep tips that customers give them directly for service they alone provide, like tables they wait on themselves. They still can’t take from the pool, even on a shift where they’re doing your job. And if customers tip into a shared jar or on a counter screen while the manager works alongside the team, the manager can’t take any of it, because those tips can’t be traced to the manager’s service alone.

### For taxes

Money a manager or supervisor receives from a tip pool, voluntary or mandatory, isn’t a qualified tip for the federal tip deduction. Tips a manager gets directly while doing a job on the IRS list, such as waiting tables or bartending, can qualify if the other rules are met.

Your state may have stricter rules.

## Common mistakes

- Assuming a shift lead or assistant manager can’t be a “manager” because of their title or pay. The duties test decides.
- Letting a working manager take a pool share because they covered a station.
- Thinking an owner is exempt because it’s their business. An owner with a 20% stake who actively manages is covered.
- Counting a manager’s pool share toward their tip deduction.
