# Can my employer make me tip out or join a tip pool?

**Short answer:** **Yes, within limits.** Federal wage law lets your employer require you to share tips with other eligible employees. The trap is who’s in the pool. If you’re paid a tipped cash wage below $7.25 an hour, a required pool can include only workers in customarily tipped jobs, like bussers and service bartenders. Cooks and dishwashers can be added only when everyone gets at least $7.25 in cash wages. Managers can never take a share.

## Example math

You’re a server paid the **$2.13** federal minimum cash wage, so your employer takes a tip credit. Your employer has told you the required contribution: say it’s 20% of your tips to a pool for bussers and service bartenders (illustrative only).

1. Tips for the week = **$1,000**.
2. Required contribution = $1,000 × 0.20 = **$200** into the pool.
3. You keep $1,000 − $200 = **$800**.
4. Your employer can count only the **$800** you kept toward its tip credit, not the $1,000 you collected.

Now say the same pool also pays the dishwasher. Because you’re on a $2.13 cash wage, that’s a problem under federal wage law. If you were paid at least $7.25 an hour in cash wages, it wouldn’t be.

**Not tax or legal advice.**

## Plain English

### Federal wage law says yes

Your employer can require you to share or pool tips with other eligible employees. Who’s eligible depends on how you’re paid.

### If you’re paid below $7.25 an hour (tip credit)

Federal law sets the tipped cash wage at **$2.13** an hour and the minimum wage at **$7.25**. If your employer pays you less than $7.25 in cash and counts your tips toward the rest, it’s taking a tip credit. Then:

- A required pool can include only workers in jobs that customarily and regularly get tips. DOL’s examples: waiters, bellhops, counter staff who serve customers, bussers, and service bartenders.
- Cooks and dishwashers can’t be in a pool you’re required to pay into.
- Your employer must tell you the required contribution amount.
- Your employer can take a tip credit only on the tips you end up keeping.

### If everyone gets at least $7.25 an hour

When your employer pays all workers at least $7.25 an hour in cash wages, it can require a pool that includes cooks, dishwashers, and other staff in jobs that don’t customarily get tips. ### Either way

- Your employer can’t keep any part of your tips, directly or through a pool.
- Managers and supervisors can’t take from the pool. See [Can my manager or the owner take money from the tip pool?](https://www.tipmaxapp.com/us/answers/can-managers-take-from-tip-pool)
- If your employer collects and hands out the pool, it has to pay it out in full by the regular payday.
- Federal law sets no cap on how much you can be required to put in. See [Is there a limit on how much of my tips I have to tip out?](https://www.tipmaxapp.com/us/answers/is-there-a-limit-on-tip-outs)

Your state may have stricter rules.

### For taxes

Whatever the pool rules, you report only the tips you keep after tip-outs. See [Do I pay tax on the tips I tip out?](https://www.tipmaxapp.com/us/answers/do-i-pay-tax-on-tips-i-tip-out)

## Common mistakes

- Assuming a required pool is illegal just because it’s required. Federal law allows it.
- Assuming any required pool is fine. On a tipped cash wage, cooks and dishwashers can’t be in it.
- Not knowing your required contribution. With a tip credit, your employer has to tell you.
- Letting a manager’s share slide because “they worked the floor too.”
