# Can I get unemployment as a server, and do my tips count?

**Short answer:** **You may, if you meet your state’s rules.** DOL says unemployment insurance is a joint state-federal program, each state runs its own, and you usually qualify if you lost work through no fault of your own and earned enough in a “base period.” On the federal side, tips you report to your employer ($20 or more in a month) count as wages for the unemployment tax your employer pays. Ask your state how it counts tips.

## What to check

1. **File with the state where you worked,** as soon as you can after losing work. DOL says claims may be filed in person, by phone, or online, depending on the state.
2. **Have your work history ready:** employer addresses and dates of employment. DOL says incomplete information can delay a claim.
3. **Know your base period.** DOL says in most states it’s the first four of the last five completed calendar quarters before you file.
4. **Check what wages your state has on record for you,** and ask whether your reported tips are included.
5. **Keep your pay stubs, W-2s, and tip log** in case you need to show what you earned.

DOL says it generally takes two to three weeks after you file to get your first benefit payment. **Not tax or legal advice.** Your state decides eligibility and benefit amounts.

## Plain English

### How unemployment works

DOL describes unemployment insurance as a joint state-federal program that pays cash benefits to eligible workers. Each state runs its own program under federal guidelines, and each state sets its own eligibility rules.

### Who usually qualifies

- **You’re unemployed through no fault of your own.** DOL says in most states this means you lost your job because there wasn’t enough work.
- **You meet your state’s work and wage requirements** during the base period.
- **You meet any other state requirements.**

### Do tips count?

The federal piece is the Federal Unemployment Tax (FUTA), which IRS says works with state unemployment systems to fund unemployment benefits. Only your employer pays it; it isn’t taken out of your pay. IRS says tips you report to your employer in writing, $20 or more in a month, are subject to FUTA, and employers add reported tips to your wages when figuring it.

How your state counts tips toward your own claim is set by your state. Ask your state’s unemployment program. DOL keeps a list of [state unemployment insurance offices](https://www.dol.gov/general/topic/unemployment-insurance).

### Why reporting tips matters here

IRS says reporting tips lets your employer report your correct earnings to Social Security, and IRS tells employers to add reported tips to your wages when figuring the federal unemployment tax. ### Where to ask

Your state’s unemployment program decides your claim. DOL’s toll-free line for questions about job loss and unemployment benefits is 1-877-US-2JOBS (TTY 1-877-889-5627).

## Common mistakes

- Waiting weeks to file after your hours are cut or you’re let go.
- Not reporting tips to your employer, then assuming your state will count them on a claim.
- Filing in the state where you live instead of where you worked, without checking.
- Guessing at dates and addresses on the claim.
