# Can I claim No Tax on Tips if I didn’t report all my tips?

**Short answer:** **You generally need tips to be properly reported to support the federal qualified tips deduction.** Qualified tips are tied to amounts on information returns (W-2 or 1099 variants) and/or tips you report on **Form 4137**. Skipping employer tip reports because “tips aren’t taxed now” is the wrong move: FICA still generally applies, and unreported tips can leave you without a clean deduction path. The **$20/month per employer** cash-tip reporting rule still stands. Claim on **Schedule 1-A Part II**.

## Example math

Cash tips for the year: **$8,000**. You reported **$6,000** to your employer; **$2,000** stayed off the books until tax time.

1. Reported path: the **$6,000** may appear on your W-2 (2026: box 12 code **TP**) if reported to your employer.
2. Unreported path: the **$2,000** may need **Form 4137**. Tips reported on Form 4137 can still count toward qualified tips if other rules are met.
3. The cap and phase-out still apply to the total qualified amount. For illustrative savings, enter **your own** marginal rate in the calculator.

**Not tax advice.** Under-reporting has payroll-tax and penalty risk beyond this page.

## Plain English

### Reporting still matters

- Report cash tips to your employer when required: generally if they total **$20 or more** in a calendar month from that employer.
- Keep a daily tip record (see IRS Publication 531 and the IRS tip page).
- “No Tax on Tips” is a **filing-time deduction**, not permission to stop reporting.

### If you already under-reported

**Form 4137** is the usual employee path for tips you didn’t report to your employer. Those amounts can still be included in qualified tips when the other IRC §224 rules are met. See [Form 4137, unreported tips, and the deduction](https://www.tipmaxapp.com/us/answers/form-4137-unreported-tips-and-deduction).

## Common mistakes

- Skipping tip reports because marketing said tips aren’t taxed.
- Assuming tip-jar cash automatically shows on the W-2 without reports.
- Treating TipMax logs as a substitute for employer reports or Form 4137.

## Last verified

September 23, 2026. Sources checked: IRS tip recordkeeping page, Publication 531, Form 4137, Schedule 1-A, and IRC §6053(a). Confirmed: the $20-a-month per employer tip reporting rule, and that tips reported on Form 4137 can count toward qualified tips.
