# How does “No Tax on Tips” work for 2026?

**Short answer:** “No Tax on Tips” is a **federal income tax deduction** for **qualified tips**, not a magic erase of every tax on tips. For tax years **2025–2028**, eligible workers can deduct qualified tips up to **$25,000 per return** on Schedule 1-A, whether they itemize or not. Tips generally still face **Social Security and Medicare**, and **your state may still tax tips**. You must report tips and meet occupation, SSN, and filing rules.

## Example math

You’re a server. You report **$12,000** of qualified tips in 2026. Your MAGI is under the phase-out. Your illustrative federal marginal rate is **22%** (illustrative only; enter your own marginal rate).

1. Deduction before phase-out = min($12,000, $25,000) = **$12,000**.
2. Illustrative federal income-tax savings ≈ $12,000 × 0.22 = **$2,640**.
3. You still generally owe **employee FICA** on reported tips: about **7.65%** combined (**6.2%** Social Security + **1.45%** Medicare on applicable wages and tips). The **2026 Social Security wage base is $184,500**, and Additional Medicare Tax may apply at higher incomes. This deduction does **not** wipe out that FICA.

**Not tax advice.** Filing status, MAGI phase-out, what counts as a qualified tip, and state law change the outcome.

## Plain English

### What actually changed

Congress created a deduction for **qualified tips** (often marketed as “No Tax on Tips”). The IRS explains that beginning in **2025**, individuals may deduct qualified tips when filing, for tax years **through 2028**.

You still **include tips as income**. The deduction then reduces taxable income (via Schedule 1-A), which can lower **federal income tax**. It does **not** mean tips vanish from your W-2 or that payroll taxes stop.

### What “qualified tips” means

Per IRS guidance, qualified tips are generally **voluntary cash tips** (cash, card, and similar cash-like payments) received in an occupation that **customarily and regularly received tips on or before Dec. 31, 2024**, and that are **reported** on an information return (W-2 or 1099 variants) or on **Form 4137**.

**Service charges and auto-gratuities** are generally **not** tips. See [Does an auto-gratuity count as a tip?](https://www.tipmaxapp.com/us/answers/qualified-tips-vs-service-charges)

### Who can claim

- Tips earned in a listed tipped occupation: [IRS tipped occupations list](https://www.irs.gov/TippedOccupations).
- A valid SSN (for employment) on the return.
- If married, you must **file jointly** to claim.
- Available whether you take the standard deduction or itemize.

### Cap and phase-out

- Max deduction is **$25,000 per return**.
- It phases out when MAGI exceeds **$150,000** (**$300,000** joint). Schedule 1-A Part II reduces the deduction by **$100 for each full $1,000** of MAGI over the threshold (partial thousands are dropped). ## Common mistakes

- Thinking FICA and state tax also disappear.
- Counting mandatory service charges as tips.
- Assuming unreported tip-jar cash still qualifies without proper reporting.
- Ignoring the occupation list.
- Expecting the TipMax app to file Schedule 1-A for you (it doesn’t).
