# How do I ask my manager for more shifts or a better section?

**Short answer:** **Ask directly, say exactly when you’re free, and ask what it would take.** Name the days and shifts you want, say you’ll pick up on short notice, and ask what you’d need to show to get busier sections. Follow up when the next schedule comes out. Federal law doesn’t decide who gets which section. It does require overtime pay past 40 hours in a workweek.

## Copy-paste texts

Names and days are made up.

| Ask | Text |
| --- | --- |
| More shifts | “Hi, it’s Sam. I’d like more hours. I’m free Monday to Thursday nights and weekend doubles. Can you keep me in mind for the next schedule?” |
| Pickups | “Hi, it’s Sam. If anyone drops a shift this week, I can take it. Text me anytime before noon.” |
| A better section or shift | “Hi, it’s Sam. I’d like to work toward Friday and Saturday dinners. What would you need to see from me to get there?” |
| Following up | “Hi, it’s Sam. Following up on more hours. I’m still open Monday to Thursday nights.” |
| After a no | “Thanks for being straight with me. Can we check in again in a month?” |

**Not tax or legal advice.** These are wording suggestions, and no wording guarantees more shifts.

## Plain English

### Make the ask easy to say yes to

- **Be specific.** “More hours” is vague. “Tuesday and Wednesday dinners” is a schedule the manager can use.
- **Be reachable.** Say when and how to reach you for last-minute pickups, and answer fast when they do.
- **Ask what they look for.** Then do that thing and mention it at the next check-in.
- **Ask in person when it’s calm.** Before a shift or after close, not during a rush.

### Pick the shifts that pay you

Not every added shift is worth the same to you. If you keep a log of tips and hours by shift, you can see your hourly for each day and meal period and ask for the ones that pay. See [How do I keep track of my tips?](https://www.tipmaxapp.com/us/answers/how-to-keep-track-of-tips)

### Overtime when you add shifts

Under the Fair Labor Standards Act, covered workers get at least one and a half times their regular rate for hours over 40 in a workweek. DOL says there’s no federal limit on hours for workers 16 and older, and hours can’t be averaged across weeks. DOL’s Fact Sheet #15 says that if you’re paid a tipped cash wage, overtime is figured on the full minimum wage, not the lower cash wage. See [Overtime for tipped employees](https://www.tipmaxapp.com/us/answers/overtime-for-tipped-employees).

### Who gets which section

We found no federal wage rule on how sections or shifts are handed out. That’s your employer’s call. Your state may have stricter rules. DOL keeps a [list of state labor offices](https://www.dol.gov/agencies/whd/state/contacts).

## Common mistakes

- Asking for “more hours” with no days or times.
- Asking in the middle of a rush.
- Not answering when the manager texts about a pickup.
- Picking up shifts without counting your hours for the week.

**Still open:** We found no federal rule on how employers assign sections or shifts. Discrimination law isn’t covered here.
