# How do I ask my manager for time off from my serving job?

**Short answer:** **Ask early, in writing, with exact dates, before the schedule for that week is made.** Use your restaurant’s request system if it has one, then text the manager so they know it’s there. A short reason is optional. Offer to help cover. Federal wage law doesn’t require vacation or paid time off, so whether you get it, and whether it’s paid, depends on your employer’s policy and your state’s law.

## Copy-paste texts

Names and dates are made up.

| Situation | Text |
| --- | --- |
| Weeks ahead | “Hi, it’s Sam. I’d like to request off Friday, June 12 through Sunday, June 14 for a family wedding. I put it in the app too. Thanks.” |
| A busy weekend or holiday | “Hi, it’s Sam. I know it’s a busy weekend, so I’m asking early: could I have Saturday, July 4 off? I can work Friday and Sunday doubles.” |
| Short notice | “Hi, it’s Sam. Something came up and I need Thursday, June 4 off. I asked Jordan and she can cover my dinner if you approve.” |
| Following up | “Hi, it’s Sam. Just checking on my request for June 12–14. The schedule comes out Friday, so I wanted to make sure you saw it.” |
| After a no | “Understood. Is there a part of that weekend I could have off, or a coworker I could swap with?” |

**Not tax or legal advice.** These are wording suggestions. Your restaurant’s request rules come first.

## Plain English

### Timing is most of it

Ask before the schedule for that week is written. Find out when your manager builds it and how far ahead the house wants requests. After the schedule is posted, you’re usually asking someone to change it, which is harder. At that point, a swap with a coworker is often the easier path: see [How do I ask for a shift swap or cover?](https://www.tipmaxapp.com/us/answers/how-to-ask-to-swap-a-shift)

### What federal law says

The U.S. Department of Labor says the Fair Labor Standards Act doesn’t require payment for time not worked, such as vacations, sick leave, or holidays. DOL calls these matters of agreement between an employer and an employee. DOL’s FLSA guide also lists “holidays off, or vacations” among things the law doesn’t require.

Being sick is different from a planned day off. See [How do I text my boss that I’m sick?](https://www.tipmaxapp.com/us/answers/how-to-text-your-boss-you-are-sick) Your state may have stricter rules on paid leave. DOL keeps a [list of state labor offices](https://www.dol.gov/agencies/whd/state/contacts).

### Keep the approval

Screenshot the approved request or the text where the manager says yes. If the schedule comes out with you on it anyway, you can point to it calmly.

## Common mistakes

- Asking after the schedule is already posted.
- Asking out loud during a rush and assuming it was heard.
- Giving a date range without the actual dates.
- Not keeping the approval.
