# My manager just told me to do something. Is that allowed?

**Short answer:** **It depends on what you were told, but federal law answers most of the common ones.** Your manager can’t keep your tips, have you work off the clock, or take deductions that drop you below the minimum wage. Other things, like breaks and paid sick days, federal law leaves to your state and your employer. Find your situation in the table below, then follow the link for the details and sources.

**Not tax or legal advice.** These are federal rules only. When your state’s rule protects you more, DOL says your employer has to follow it.

## Plain English

### Who makes these rules

Most of the pay questions above fall under the federal Fair Labor Standards Act, which DOL’s Wage and Hour Division enforces. Harassment and discrimination fall under laws the U.S. Equal Employment Opportunity Commission (EEOC) enforces. Your state may have stricter rules on any of these, and DOL says your employer has to follow whichever rule protects you more. DOL keeps a [list of state labor offices](https://www.dol.gov/agencies/whd/state/contacts).

### How to raise it

1. **Talk to your manager or the owner.** Many problems are mistakes. Ask plainly, for example: “My card tips from Friday aren’t on this check. Can you look into it?”
2. **Put it in writing.** Send a short, polite text or email with the date and what happened. Keep copies somewhere other than a work device, along with your own notes of hours and tips.
3. **Call DOL’s Wage and Hour Division** for pay, tips, hours, and breaks: 1-866-487-9243. DOL says complaints are confidential and that an employer can’t retaliate against you for filing one. See [How to file a complaint](https://www.dol.gov/agencies/whd/contact/complaints).
4. **Contact EEOC for harassment or discrimination:** 1-800-669-4000, or see [How to file a charge](https://www.eeoc.gov/how-file-charge-employment-discrimination). There’s a deadline: 180 days, extended to 300 days in some places.

## Common mistakes

- Assuming “that’s how every restaurant does it” means it’s allowed.
- Raising a pay problem only out loud, with no dated text or email.
- Waiting months to raise it. EEOC charges have a deadline, and pay records get harder to piece together.
- Checking only federal law. Your state may protect you more.
