# Do we have to file jointly to claim No Tax on Tips?

**Short answer:** **If you are married, yes: you must file a joint return to claim the federal qualified tips deduction.** Schedule 1-A Part II cautions that married individuals must file jointly. Married filing separately blocks the claim path, and the TipMax calculator shows $0 for it. The cap is still **$25,000 per return**; phase-out starts at **$300,000** MAGI for joint filers ($150,000 for unmarried filers using the single threshold). Valid SSN rules still apply. FICA and state tax are separate issues.

## Example math

Spouse A qualified tips: **$18,000**. Spouse B qualified tips: **$10,000**. Married filing jointly. Combined MAGI: **$280,000** (under the $300,000 joint threshold).

1. Combined qualified tips = **$28,000**.
2. Cap → deduction **$25,000**.
3. Phase-out → **$0** reduction (MAGI under the joint threshold).
4. Illustrative savings: **enter your own marginal rate** (e.g. 22% → ≈ $5,500 illustrative).
5. Contrast: same facts but **married filing separately** → deduction **not available** under the joint-filing rule.

**Not tax advice.** Joint vs separate has many non-tip consequences. Talk to a tax pro about the whole return.

## Plain English

### Why this trips people up

Couples sometimes file separately for other reasons and then wonder why software hides the tip deduction. The Schedule 1-A caution and the IRC §224 married-individual rule require a **joint** return.

### Cap and phase-out on a joint return

- One **$25,000** cap for the return (not $25,000 each).
- The joint phase-out threshold is **$300,000** MAGI. The deduction drops by $100 for each full $1,000 of MAGI over it. See [the cap and phase-out page](https://www.tipmaxapp.com/us/answers/no-tax-on-tips-dollar-cap-and-phase-out).

## Common mistakes

- Assuming each spouse gets a separate $25,000.
- Filing married filing separately “just this year” and losing the tip deduction unexpectedly.
- Forgetting SSN requirements for the spouse who received tips.
