# What benefits can servers get in Massachusetts?

**Short answer:** **Up to 26 weeks of paid leave a year.** Massachusetts PFML gives up to 20 weeks of paid medical leave for your own serious health condition and up to 12 weeks of family leave, 26 weeks combined in a benefit year. Wages up to half the state average are replaced at 80%, capped at $1,230.39 a week in 2026. The state EITC adds 40% of your federal credit.

## The rules in Massachusetts

| Rule | What it says |
| --- | --- |
| Paid Family and Medical Leave (PFML) | Up to 20 weeks of medical leave for your own serious health condition and 12 weeks of family leave to care for a relative or bond with a child, 26 weeks combined per benefit year. Apply online at paidleave.mass.gov, up to 60 days ahead, after telling your employer. |
| Who qualifies | Full-time, part-time, and seasonal employees, and people unemployed 26 weeks or less, who meet the yearly minimum earnings test over the last 4 completed quarters and earned at least 30 times their weekly benefit. Earnings from all jobs count. |
| Weekly benefit, 2026 | 80% of your average weekly wage up to half the 2026 state average weekly wage of $1,922.48, plus 50% above that, capped at $1,230.39. There’s a 7-day waiting period. |
| Job protection | Once you tell your employer you need leave, you’re protected against changes in pay, losing benefits, and retaliation. |
| Earned sick time | 1 hour per 30 worked, up to 40 hours a year. Paid at employers with 11 or more employees; unpaid but protected at smaller ones. |
| Massachusetts EITC | 40% of your federal EITC for tax years from 2023: up to $260 with no children and $3,218 with three or more for tax year 2025. File a Massachusetts return. |
| Child and Family Tax Credit | $440 for each dependent child under 13, disabled dependent or spouse, or dependent 65 or older, with no limit on the number, from tax year 2024. |
| MassHealth and Health Safety Net | One application checks MassHealth, the Health Safety Net, and the Children’s Medical Security Plan. |

## What’s different in Massachusetts

Your own medical leave runs longer here than family leave: 20 weeks against 12. For a server recovering from surgery, that’s five months of partial pay rather than three. The benefit year starts the Sunday before your first day off and locks your rate for 52 weeks.

The formula uses your two best-earning quarters in the base period, which helps if your restaurant is seasonal. DFML looks at earnings from every job you held, so a second server job counts toward eligibility. At tax time, the $440-per-child credit has no cap on the number of kids. Plus the federal programs.

**Still open:** The DFML pages we read don’t say how reported tips count in your average weekly wage, and they don’t state the dollar amount of the yearly minimum earnings test. The Health Connector site (ConnectorCare) didn’t load when we checked.
