# Does my restaurant have to give me paid leave in Nevada?

**Short answer:** **Only if it has 50 or more employees in Nevada.** Since January 1, 2020, a private employer that size must give 0.01923 hour of paid leave for each hour you work. The state notice says you can use the leave for any purpose. Smaller employers aren’t covered by this rule.

## The rules in Nevada

> “Effective January 1, 2020, yes, a private employer who employs 50 or more employees in the state of Nevada must provide 0.01923 hour of paid leave per hour of work performed.” (Nevada Labor Commissioner: frequently asked questions, https://labor.nv.gov/About/Frequently_Asked_Questions/Frequently_Asked_Questions_-_About_Us/)

## What’s different in Nevada

Federal wage law gives you no paid leave. Nevada does, but only at larger employers: the 50-employee line counts workers in the state, so a casino resort restaurant and a single neighborhood bistro can land on opposite sides of it.

The leave isn’t labeled sick-only. The required workplace posting says you can use it for any purpose, which makes it closer to general paid time off. With no tip credit in Nevada, each leave hour pays at least your $12.00 wage. The accrual is small per shift, so the balance grows slowly unless you work steady full-time hours.

The Labor Commissioner sets the rate at 0.01923 hour of paid leave for every hour you work. By our arithmetic, a full-time year of 2,080 hours works out to about 40 hours of leave; a part-time schedule earns proportionally less.
