# Does the tip credit / tipped wage change under No Tax on Tips?

**Short answer:** **No. The federal “No Tax on Tips” deduction does not rewrite tipped minimum wage or the FLSA tip credit.** Those are **wage and labor** rules (DOL, FLSA, state wage law). The tip deduction is an **income-tax** rule under IRC §224, claimed on **Schedule 1-A Part II**. Your employer can still pay a tipped cash wage and take a tip credit where allowed. You can still owe FICA on tips and may still claim the deduction if you meet IRS rules.

## Example math

Hourly tipped cash wage: **$2.13** (illustrative federal FLSA tipped wage figure; **confirm current DOL rules and your state**. TipMax Answers does not hardcode your state’s wage). Tips reported for the year: **$15,000**. Single; MAGI under the phase-out.

> Still being verified: Current federal DOL tipped cash-wage dollar figure. $2.13 is used here only as an illustration.

1. Wage and tip-credit rules still govern what your employer may pay under FLSA and state law. IRC §224 doesn’t change them.
2. Income-tax side: qualified tips deduction ballpark = **$15,000** if you meet the §224 rules.
3. Illustrative federal income-tax savings: **enter your own marginal rate** in the calculator.
4. FICA on reported tips still generally applies.

**Not tax advice.** For wage complaints or tip-credit disputes, go to the DOL or your state labor agency, not Schedule 1-A.

## Plain English

### Two rulebooks

- **Tipped cash wage and tip credit:** set by the FLSA, DOL, and state wage law. “No Tax on Tips” **does not replace** those rules.
- **Federal qualified tips deduction:** IRC §224, claimed on Schedule 1-A Part II. It may reduce **federal income tax** if you qualify.
- **Social Security and Medicare:** FICA payroll taxes. They generally **still apply** to reported tips. See [Do I still pay Social Security and Medicare on tips?](https://www.tipmaxapp.com/us/answers/do-i-still-pay-social-security-medicare-on-tips)

### Why workers mix them up

Marketing collapsed “tips” into one slogan. Your paycheck still shows a tipped wage path; your tax return may show a separate deduction. Wage figures change, so confirm DOL or state sources before relying on any dollar cash-wage example.

## Common mistakes

- Thinking §224 forces employers to pay full minimum wage in cash.
- Skipping tip reports because “tips aren’t taxed.”
- Asking TipMax to settle a tip-credit wage claim (it won’t).

## Last verified

September 23, 2026. IRS tip recordkeeping page, Schedule 1-A, IRS Topic 751, and the DOL FLSA overview. Confirmed: the federal tip deduction is an income-tax rule under IRC §224 claimed on Schedule 1-A Part II, and FICA still generally applies to reported tips.

**Still open:** Tipped cash-wage dollar figures and state tip-credit rules change. The $2.13 example is illustrative; confirm current DOL and state sources before relying on it.
